All services are subject to availability and a separate Statement of Work (SOW) or contract where applicable.
4. Pricing and Payments
- All prices are quoted in South African Rand (ZAR) and exclude VAT unless stated otherwise.
- Basic Website Package: R2,000.00
- Business Growth Package: R500,000.00
- Domination Package: R20,000.00
- For custom services, a quote will be provided before work begins.
- Payment terms: 50% deposit required before project commencement, remaining 50% upon delivery (or as agreed in writing).
- We accept payments via bank transfer, credit/debit card, PayPal. All payments are non‑refundable unless otherwise stated in a signed agreement.
5. Refund and Cancellation Policy
- You may cancel a project within 7 days of making a deposit, subject to a 20% administration fee.
- Once work has commenced, no refunds will be issued.
- For pre‑packaged solutions (e.g., Basic Website Package), refunds are only available if we fail to deliver the agreed scope within 30 business days.
6. Delivery and Timelines
- Delivery estimates are provided in good faith but are not guaranteed. Delays caused by third parties, incomplete client input, or unforeseen technical issues shall not constitute a breach.
- You agree to provide all necessary materials, feedback, and approvals in a timely manner.
7. Intellectual Property
- All custom code, designs, and deliverables created by Madina Baye Tech remain our intellectual property until full payment is received.
- Upon final payment, we grant you a perpetual, non‑exclusive license to use the delivered product for its intended purpose.
- You retain ownership of your content (text, images, logos). You warrant that you have the right to use any content you provide.
8. Client Obligations
- You shall cooperate with us, provide accurate information, and not misuse our services.
- You may not reverse‑engineer, resell, or redistribute our software without explicit written consent.
9. Limitation of Liability
To the maximum extent permitted by law:
- Madina Baye Tech shall not be liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss, business interruption).
- Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the preceding 6 months.
10. Warranties and Disclaimer
- We warrant that our services will be performed with reasonable skill and care.
- Except as expressly stated, we provide all services “as is” and disclaim all implied warranties (e.g., merchantability, fitness for a particular purpose).
11. Governing Law
These Terms are governed by the laws of South Africa. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Bloemfontein.

We may update these Terms from time to time. The latest version will always be posted on our website. Continued use of our services constitutes acceptance of any changes.
